Facts

Following the elections for Governorship of Adamawa State conducted by INEC, Alhaji Atiku Abubakar (who was the gubernatorial candidate on the platform of the Peoples Democratic Party (PDP)) emerged winner and his running mate was the 2nd appellant herein.

On 16th January, Atiku was nominated by Olusegun Obasanjo on the platform of PDP as his running mate for the office of President which the former accepted.

INEC then wrote to Atiku on 26th February, 1999 noting that having not been sworn in as Governor, his Deputy could not be sworn in as Governor in his place. INEC then made preparations to hold the governorship election of Adamawa State.

The appellants sought to stop any such plans by INEC
